A no-fault state, under California law parties to a marriage or domestic partnership may file for divorce or dissolution based only on irreconcilable differences.

Simply stated, the term irreconcilable differences is defined as a couple’s inability to effectively communicate or maintain their marital relationship due to disagreements. Either spouse may file for divorce, even if the other party does not consent to the dissolution of their marriage.
