Simply stated, the term irreconcilable differences is defined as a couple’s inability to effectively communicate or maintain their marital relationship due to disagreements. Either spouse may file for divorce, even if the other party does not consent to the dissolution of their marriage.
Residency requirements must be met prior to filing for an annulment or divorce. At least one party must be a resident of the State of California before the court will exercise jurisdiction over the matter.
However, residency requirements are waived when filing for legal separation. Upon agreement of both parties to the marriage, the court may grant a legal separation even when one or both spouses have resided in state for less than six months.
